Lessons from Real Life: Why Everyone Needs an Advance Health Care Directive

End-of-life decisions are among the most difficult a family will ever face. Most people do not like to think about life support, ventilators, and artificial food and hydration. Young people, especially, believe that end-of-life decisions can wait until later. The case of 33-year-old Marlise Munoz should be a wake-up call for everyone.

The Maryland legislative session is in full swing. The following are very brief “thumbnails” of bills which are generally considered of some importance in the labor and employment arena. Each bill must be consulted for specifics and a more complete understanding of the provisions of the legislation.


Get Dressed! But Don’t Expect The Company to Pay for It!

Sandifer v. United States Steel Corporation, U.S. Supreme Court No. 12-417, decided January 27, 2014 (appeal from the U.S. Court of Appeals for the Seventh Circuit), is one of the rarer instances in which the Supreme Court unanimously agrees on something—“clothes” means the ordinary and plain meaning of the word no matter how much the litigants try to torture the definition. More specifically, in the Sandifer case, the definition of “changing clothes” under the Fair Labor Standards Act (FLSA) was at issue.


It’s Not Too Late to Use Your Spouse’s Unused Estate Tax Exclusion

In Revenue Procedure 2014-18 the IRS provided an extension of time to those who wished to be sure that a decedent’s surviving spouse could benefit from the concept known as “portability”. In the Procedure, the IRS provides the ability for an estate of a decedent who died after December 31, 2010 and before January 1, 2014 to “port” the unused portion of the deceased spousal unused exclusion amount or “DSUE” to the surviving spouse.


Background Checks: Not Over until It’s Over!

In all the hoopla over the victory of the employer in EEOC v. Freeman (USDC, MD, Case No. RWT 09-cv-2573) it may have escaped some people that on November 7, 2013 the U.S. Equal Employment Opportunity Commission (“EEOC”) appealed its loss at the hands of U.S. District Court Judge Roger Titus to the United States Court of Appeals, Fourth Circuit (Case No. 13-2365). The EEOC argued in this (and other similar cases) that background checks resulted in “disparate treatment” of protected classes of minorities under Title VII of the Civil Rights Act.

Little did the parties or the Ninth Circuit know that the case would become a cause celeb for the Supreme Court of the United States, which is to hear oral arguments in the case on January 13, 2014.
