Tom Gisriel, Successfully Argues To Have Will Set Aside On Grounds Of Undue Influence

In a reported decision by the Court of Special Appeals, Tom Gisriel successfully argued that the Orphans’ Court for Baltimore City erred in rejecting as untimely the appellant’s Petition to Transmit Issues to the Circuit Court.  Russell v. Gaither, 181 Md.App. 25 (2008).  On remand, in a week long jury trial in the Circuit Court for Baltimore City, Tom successfully set aside a will on grounds of undue influence exercised by a fellow church member, causing the testator to execute a will naming her as a personal representative and another church member as a major beneficiary.
