The New Year is almost here and it’s time to put your estate planning on the top of your “to do” list. If you don’t have an estate plan in place, now is the time to put one in place. The U.S. Fourth Circuit Court of Appeals, which covers Maryland, recently rendered a tax decision noteworthy to all married couples who participate in their business together. The case, Johnson v. U.S., decided November 5, 2013, is significant because a wife, who participated in a company with her husband on a limited basis, was held liable for unpaid payroll taxes in spite of the fact that she had only limited involvement with the operation of the company and did not learn of the failure to pay the payroll taxes until she was notified by the IRS.
